User Acknowledgment and Health Responsibility Agreement

By accessing, registering for, or using this website, mobile application, and any related content, programs, services, or materials (collectively, the “Platform”), you represent and warrant that you are at least eighteen (18) years of age, or that you are the parent or legal guardian of a minor user and are creating and managing this account on their behalf and consent to the minor’s participation

You acknowledge and agree that participation in any exercise, rehabilitation, fitness, or wellness program involves inherent risks, including but not limited to physical injury, illness, aggravation of existing conditions, permanent disability, death or other adverse health effects

By using the Platform, you understand and agree that if you experience any pain, discomfort, fatigue, shortness of breath, dizziness, lightheadedness, headaches, muscle soreness, chest pain, nausea, weakness, loss of coordination, or any other unusual or concerning physical symptoms prior to or during the use of any program, routine, exercise, or instructional content, on the platform you must immediately discontinue all physical activity and seek immediate medical advice from a licensed physician or other qualified healthcare provider.

You further agree that you will not resume participation in any activities provided through the Platform until you have received medical clearance from your physician or qualified healthcare provider.

You acknowledge that you are solely responsible for monitoring your physical condition and determining whether you are medically fit to participate in any activities offered through the Platform. You agree to consult with a licensed healthcare professional before beginning any program, particularly if you have pre-existed medical conditions, injuries, disabilities, cardiovascular conditions, neurological conditions, orthopedic limitations, pregnancy, or any other health concerns

You acknowledge and agree that the Platform does not provide medical diagnosis, treatment, prescriptions, or personalized medical advice and is not a substitute for in-person medical care. All content, programs, and materials are provided for general educational and informational purposes only.

You further acknowledge that participation in rehabilitation or therapeutic programs offered through the Platform should occur only pursuant to referral, recommendation, or approval by a licensed physician or other qualified healthcare professional, when clinically appropriate

If you are participating in any injury-specific, rehabilitation, or medically oriented program through the Platform, you acknowledge and agree that you are responsible for ensuring that you are under the supervision, guidance, and progression of a licensed professional healthcare practitioner who is qualified in the relevant specialty area

The Platform does not replace, override, or interfere with the clinical judgment of your treating physician, physical therapist, athletic trainer, or other licensed healthcare provider

By using the Platform, you voluntarily assume all risks associated with your participation, including risks arising from known or unknown medical conditions, improper use, misuse, or failure to follow professional guidance

You expressly acknowledge and agree that your use of the Platform is voluntary and at your own risk, and that you accept full responsibility for all consequences arising from your participation.

 

Release of Liability & Waiver of Claims

To the fullest extent permitted by law, you hereby knowingly, voluntarily, and expressly release, waive, discharge, and covenant not to sue the TherexPT, its parent or subsidiary companies, owners, officers, directors, employees, contractors, licensors, content creators, medical advisors, affiliated healthcare professionals, agents, successors, and assigns (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses of any kind, whether known or unknown, suspected or unsuspected, arising out of or related to your access to or use of the Platform or any injuries or other damages arising there from

This release includes, without limitation, claims arising from or related to

Participation in any exercise, rehabilitation, fitness, or wellness program;

Physical injury, illness, aggravation of pre-existing conditions, pain, disability, or death;

Improper performance of exercises or misuse of content;

Reliance on information provided through the Platform or;

Technical errors, omissions, interruptions, or content inaccuracies in the platform

You understand and agree that this release applies even if a claim arises from the ordinary negligence of any of the Released Parties but does not apply to claims arising from gross negligence or willful misconduct, where prohibited by law.

You expressly acknowledge that you are voluntarily participating in activities offered through the Platform with full knowledge of the inherent risks involved and assume all risks, both known and unknown.

If you are a parent or legal guardian consenting on behalf of a minor, you agree to fully release and waive all claims on behalf of the minor user permitted by law.

 

Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your use or misuse of the Platform;

Your participation in any program, exercise, or activity provided through the Platform;

Your failure to follow medical advice, safety instructions, or professional guidance;

Any breach of this Agreement or violation of applicable laws or regulations;

Any claim brought by or on behalf of you or a third party (including a minor) arising from your use of the Platform.

This indemnification obligation shall survive termination of your account and continued use of the Platform.

 

Acknowledgment of Understanding

By accessing or using the Platform, you acknowledge that you have read, understood, and voluntarily agree to this User Acknowledgment and Health Responsibility Agreement, including the Release of Liability & Waiver of Claims and Indemnification provisions. You understand that by accepting this Agreement electronically, you are waiving certain legal rights, including the right to sue.
